Variable, LLC - Terms and Conditions
The terms and conditions below apply to all coaching provided by Variable, LCC (“the Coach”) to any individual or organization ("the Client") and constitute the contract for the service to be provided by the Coach for the Client. The term 'coaching' covers all courses and programs relating to coaching for filmmakers.
In return for the fees payable by the Client (or by a third party on their behalf), the Coach agrees to provide the service as described at www.wearevariable.com and in accordance with the terms and conditions set out below. The Client agrees to pay fees for the service on the terms and conditions set out below (in situations where a third party pays the fees, the third party counts as an agent acting on behalf of the Client).
The date that the first paid coaching session takes place shall be deemed the start date for the service. Participation by any individual in the first paid coaching session constitutes acceptance of these terms and conditions.
Responsibilities:
The Coach (Variable, LLC) will work with the Client to reach towards his/her desired outcome(s) that he/she shared in the intake document(s) and first session between Coach and Client. Remarkable results can be achieved where Clients follow a clear plan in a committed way. However, the Client has sole responsibility for taking important decisions in their life or business. The Coach has no liability for any loss incurred by any Client, whether financial or otherwise, following commencement of coaching sessions, or for any perceived failure by the Client, whether justified or otherwise, to achieve a material improvement in quality of esteem, life, business or to achieve their desired outcomes or goals.
The Coach is being hired for one-to-one sessions to take place digitally. The sessions will be 60-minutes long, with the exception of the first call between the Coach & Client which will be 90 minutes.
The Client understands that the Coach is being hired for individual sessions, and not to be readily available in between sessions.
Confidentiality:
All conversations and personal information shared between Clients and Coach (Variable, LLC) is strictly confidential. I ask that you do not share any of my business information that is not already public, nor any consulting notes or documents.If you haven’t already, you can also review our NDA for coaching clients here: https://wearevariable.com/coachingnda - If you did not check the box approving the NDA in your intake document, we will have to come to an agreement prior to beginning any coaching work.
Payment Terms
Fees can be paid online by debit or credit card or by bank transfer using the booking link at wearevariable.com in “Variable Scheduling”: https://variable.as.me/schedule.php
Fees are payable in advance of each coaching session unless otherwise agreed. Where payment has not been received by the Coach in advance of a coaching session the Coach is not obliged to provide the session.
Variable, LLC has a no refund policy as a way of honoring the client’s commitment to personal development, informed decision-making, and accountability.
Scheduling, Cancellations & Refunds:
All bookings are final. No refunds will be issued to Clients for coaching.
If the Coach has to cancel a weekly session for any reason, the Coach will issue the Client a full refund for that session or the option to reschedule to a later date. If Client has to cancel a weekly session, Client must cancel at least 48 hours in advance and reschedule to a later date.
If Client reschedules within a 48-hour window prior to your session, they will be charged a $75 booking & convenience fee.
If Client arrives late to a session, the remainder of the Client’s scheduled session will be used to complete as much as possible. Sessions can not run long due to the scheduling of other clients. There are no refunds if the Client don’t show up to their session.
Matters of Wellness:
The Coach is not a registered psychologist or psychiatrist, nor licensed therapist. The Coach does not engage in therapy with coaching clients. In entering into the coaching relationship, the Client are agreeing that if any mental health difficulties arise during the course of the coaching relationship, the Client will consult with mental health professionals.
Coaches may inquire about Clients personal wellness throughout the coaching process as a means to instill wellness practices into the Clients lives. It is entirely up to the client if they choose to engage in conversations surrounding wellness.
For Three Month Clients (In addition to everything stated above and below):
This is a three month coaching process that aims to help Clients thrive amidst competitive realities of the filmmaking business. The goal of the coach is to empower filmmakers while leading them towards their goals, using their values as the compass.
Once the Client books “Three-Month Quarterly Goals” coaching service, the Client agrees to schedule weekly sessions within a consecutive three month timetable. Emergencies are accepted as an appropriate means of delay.
Unused portions of coaching packages will not be refunded. It is the clients responsibility to book and complete the work within the agreed-upon timeline.
Payment must be made on a monthly basis.
Termination ‘good-faith’ agreement: If either party decides that the other isn’t a good match throughout the three-month coaching process, we agree to schedule a brief 'alignment call' to discuss how we can improve our work together, or terminate our work all-together. No work will be officially terminated until a concrete conclusion has been reached on our 'alignment call'. In the case that work is terminated, the client will be refunded the remaining balance minus a $150 booking & convenience fee.
Between Sessions:
The Coach may assign the Client tasks or exercises to complete between coaching sessions. There is no obligation on the Client to complete these items of ‘homework’, but not doing so may slow the Client's progress towards achieving desired business or personal outcomes.
Where possible, Clients are requested to submit any information requested by The Coach relating to assignments at least 24 hours before the coaching session. This will allow both the Client and Coach to prepare for the session.
If Client needs to ask the Coach something between sessions, the client understands that it can take the coach up to 86 hours to get back to them. If the question from the Client is an emergency, the Client will put “Emergency” in the subject line of the email and the Coach will get back to the Client as soon as possible. Regardless, it should be understood The Coach is being hired for individual sessions, and not to be readily available in between sessions.
Governing Law
This contract is governed by the law of Maryland whose courts have exclusive jurisdiction in relation to any dispute, disagreement, proceedings or legal claim of any nature relating to the service provided or the contract.
